List of Fees for Real Estate and Financing Departments


REAL ESTATE FEES

Fees effective March 31, 2003.

For entering and recording any deed, mortgage certified copy, lis pendens or other instruments: 

Recording fee  $10.00 
State Survey & Remonumentation fee  $4.00 
Total for first page  $14.00 
Each additional page  $3.00 
A $3.00 fee shall be added to any document that assigns or discharges more than one instrument.


Documents filed in the Register of Deeds office must be
eligible for recording.

Warranty deeds, land contracts or deeds that contain a covenant of warranty must be tax certified at the Oakland County Treasurer's Office.

Land Transfer Tax
Pubic Act 134, 1966 and 
Public Act 255, 1994

An act to impose a tax upon written instruments which transfer any interest in real property: to provide for the administration and provide penalties for violations of the act.

The Act provides that on all deeds of conveyance where the value or consideration exceeds $99.99.

Transfer Tax stamps are required to be affixed and canceled by the seller at the rate of .55 for each $500.00 or fraction thereof for the County. State Transfer Tax is computed at the rate of $3.75 for each $500.00 or fraction thereof per Public Act 255, 1994.

The Tax is computed upon full consideration for the transfer.

Instruments where the value of the consideration of the gift is less than $100.00 are exempt. For other exemptions, see Act. Reason for exemption must be shown on face of instrument.

If you find it convenient to use the mail to send us instruments for recording, we will service them for you by obtaining a Treasurer's Tax Certificate ($1.00 - one to five descriptions inclusive, $.20 each additional description), attaching revenue stamps, etc. Please enclose check to cover desired services.

The total check should include both Real Estate and Financing Fees.

 

Termination $15.00

Real Estate Fees for Terminations

If a Financing Statement was recorded with the Real Estate Department then the Termination must also be recorded with the Real Estate Department, including the real estate description and applicable recording fees:  

First Page $7.00
Each Additional Page $2.00
The total check should include both Real Estate and Financing Fees.

Request for Information and Copies

Certificates $6.00 plus $1.00 per entry
Searches at counter w/no written verification $5.00
Copies $1.00
Certification of Copy $1.00
Searches for State Leins, Federal Leins and/or Fixture filings $3.00
If certificate discloses more than 100 presently effective recordings concerning the Debtor $6.00

Senate Bill #381 excepts the following from the MSSR fee. The following fees apply to both the Real Estate and Finance (UCC) Departments:

When you leave an original instrument with us, it is recorded by the most modern microfilm method, insuring safety and replacement any time. It is indexed by names and tract and returned promptly by U.S. mail unless otherwise requested.
